Who Adjustment of Status May Be Right For

Adjustment of Status may be available to applicants who are already inside the United States and have an immigrant visa immediately available. For many employment-based applicants, this means having an approved I-140 and a current priority date.

Approved or Filed I-140

Many employment-based applicants file Adjustment of Status after an I-140 is approved. In some cases, concurrent filing may be available.

Current Priority Date

Your priority date generally must be current under the Visa Bulletin before USCIS can approve the green card application.

Inside the United States

Adjustment of Status is for eligible applicants applying from inside the United States. Applicants outside the U.S. generally use consular processing.

Eligible Dependents
